Cyberspace Law
Legal research links |
|
This area includes many links to resources on cyberspace law, as well as a set of lecture outlines prepared in mid-2001 for a NTU undergraduate unit I taught in semester 2 2001. Neither the links nor the teaching materials have been revised since then, so they should be treated with caution.
- Internet Law Library - by US lawyer Martin H. Samson - summaries of court decisions (mostly American) shaping the law of the web; providing facts, analysis and pertinent quotes from cases including copyright, trademark, dilution and other intellectual property issues, jurisdiction, linking, framing, meta tags, clip-art, defamation, domain name, e-mail, encryption, gambling, click-wrap agreements, shrink-wrap licenses, spamming and other subjects.
- Cyberlaw Encyclopedia - by Canadian lawyer Alan Gahtan - categorises material as statutes, cases, articles, and policy - well organised and easy to use. Links focus on US, Canadian and European material. Also see some articles by Alan Gahtan.
- Roger Clarke articles:
Other resources
- The Journal Articles Index accessed from the left column concentrates on Australian law journal (and law firm) articles, although I have also indexed recent articles (back to 1998) from Warwick University (UK) Journal of Information, Law and Technology (JILT). For US secondary sources, the UCLA Online Institute for Cyberspace Law and Policy contains extensive, well-organised and up-to-date links to online articles as well as a bibliography of 'hard copy' sources. Note, however, that Wilson's Index to Legal Periodicals (WILP) remains the pre-eminent general bibliographic database for locating US journal articles (students can obtain the user-name and access password from Ken Parish or law librarian Sonya Pennington);
- History of the Internet by Roger Clarke; History of the Internet (links to papers by various authors);
- Gilbert & Tobin (solicitors) publications;
- Cornell University Computer Policy and Law Program;
- FindLaw Cybercrime page;
- Commonwealth A-G's Department E-Commerce page;
- Electronic Frontiers Australia - a non-profit national organisation representing Internet users concerned with on-line freedoms and rights;
- GigaLaw.com - "Legal information for Internet and Technology Professionals" - articles, newsletter, discussion forum, etc.;
- e.Law Practice Online - LBC online magazine covering practical legal, strategic and tactical issues on ecommerce for the Australian and Asia Pacific region;
- Carnegie Mellon Institute for eCommerce - Ecommerce Law Links (extensive, well-organised links - mostly US) - also see eLibrary and Hyperdictionary of E-Commerce Law;
- Baker & McKenzie (global law firm) E-Commerce site - includes Global E-Law Alert and Global E-Commerce Law (covering the USA and over 30 other countries, including summaries, analysis and full text of legislation and regulations governing electronic transactions. Bills itself as the world's most comprehensive online resource for e-commerce law);
- Internet Censorship - VicNet - numerous articles and links on this issue;
- LegalEthics.com - US focus but some useful articles and case notes;
- Caslon Analytics - Australian internet research, analysis and strategies consultancy (numerous useful papers).
