Tertiary Music Licence Agreement
The Charles Darwin University is signatory to an agreement negotiated by Universities Australia with the combined music collecting societies.
This agreement enables CDU to reproduce, communicate and perform an extensive repertoire of musical works without having to obtain prior permission of copyright holders
The music collecting societies involved are:
- Australasian Mechanical Copyright Owners Society (AMCOS)
- Australasian Performing Right Association (APRA)
- Australasian Record Industry Association (ARIA)
- Phonographic Performance Company of Australia (PPCA)
So what exactly can staff at CDU do under the agreement?
Under the agreement CDU Staff are allowed to:
- have students (and/or staff) perform copyright music (or APRA Works) for educational purposes, or for a University event (no admission charge);
- make audio recordings in any format for and of University Events, and provide the recording to students for class related use;
- make video recordings in any format for educational purposes for or of University Event, or as part of course instruction;
- synchronise audio and video recordings for educational purposes;
- perform in public sound recordings for educational purposes and University Events;
- perform music in the workplace for the sole benefit of University employees;
- play music on hold via the telephone system.
Marking requirements
All copies made under the agreement must be marked either on the packaging, labelling, or file heading the following text notice:
Additionally, the following information should be included:
- title of each musical work
- name of each composer, lyricist and arranger of the musical work
- if ARIA sound recording, the artist/group name, and the record company label.
Limitations – naturally!
This Music Licence does NOT include the following activities:
- Copying musical scores – still restricted to 10% of the work under the CAL agreement;
- Downloading sound recordings is NOT permitted – can only be provided for listening;
- Reproducing cinematographic film;
- Broadcasting musical work or sound recording;
- Copying or performing music in relation to Grand Right Works, Choral works of more than 20 minutes, Dramatic Works, or ballet;
- Copying musical works not covered by music societies party to the agreement, ie ARIA, AMCOS, APRA and PPCA.
Survey
Another requirement of the agreement is to participate in an annual survey. Each year, CDU will be required to provide a snapshot of sound recordings held on IT systems in Central Units as at 1 October for the relevant calendar year. At CDU, Teaching and Learning Development Group have been declared as the Central Unit for this purpose
